Is BlackHat Legal?

Hey guys.

I've been wondering about this for a while, and I was checking some of the comments that needed approval on one of my videos... And someone is just like : Here is the scammers info : ---
Had my address, IP, name, email and stuff, and I must say it kind of scared me.

So my question is : Is this legal? What can be the consequences? Thanks for clearing this up. I'm really considering starting a new journey into WhiteHat. Sure, I won't make $500 a day like I am now, but at least I'll have a sense of accomplishment, and most of all I won't feel threatened.

Do you really think that you will make less with Whitehat niches than with Blackhat ones?
I would like to know why do you think it?

I don't think I will make less.
I just don't think I will make $500 the first day, it will take me so time to climb back to where I am right now with blackhat.

Do you have any idea how he got your info? Maybe Whois or something. I also would be scared if that happened.

I don't have whois protected, but I have an alias... He got my real info though, so I don't know..

Some may consider promoting fake content as fraud, In the US "Fraud must be proved by showing that the defendant's actions involved five separate elements:
(1) a false statement of a material fact
(2) knowledge on the part of the defendant that the statement is untrue
(3) intent on the part of the defendant to deceive the alleged victim
(4) justifiable reliance by the alleged victim on the statement
(5) injury to the alleged victim as a result."

Depending on the way you promote it you may be doing all these things...

1. In the description write that the content can be different or something like this.
2. On your site write the Terms of Service. Write clearly that the information on the website can be misleading...No one will read the TOS but you said it. I usually write that I'm not providing the real thing in the description of the fake file because everyone that want your file search for the download button. They don't have time to read the description.
3. Try to give something related to your niche not a simple txt.

It's illegal, but it's not something that a police would investigate about, unless 100's of people report you, which will not happen. Just make sure you use whois protection on all your domains and never leave your footprints on your videos/blogs/sites of any kind.
It can help if you leave a terms of service on your sites and include following statements :

1) All trademarks mentioned here belongs to their respective owners. ( avoid copyright issue )
2) All services/products provided here are for entertainment only, you cannot get any real codes/services/products here, all programs here are for fun only. ( then you can write how they can use that to make fun with their friends etc etc )
3) By clicking on download link you agree with the above mentioned TOS

And also put something more, i don't know what your niches are, so try to acclimate it. All in all, with first two mentioned terms you are safe, unless you provide cracked stuff, then there is nothing you can write.
