I bought domain one month ago and i started to insert articles and little seo. Today i see that This domain haven't the Whois protection and i delete all (is bh niche website), and cancell all file. I bought other .com domain with Whois protection but my question is, if i upload all file backup from old cancell site to new website, google penalized me for duplicated content?

This really depends on some factors.

How many pages are indexed at Google for your old domain?

This place is intentionally left blank.

You deleted everything just because you didn't had whois protection? Why? Is totally unnecessary.

And if your old site is deleted and not hosted, is fine to use the files.

wait for a while for the pages from old domain to get deindexed from google, your strategy was bad from the begining, a 301 redirect would have been better

Hopefully you don't use the same Google Webmaster account for both domains.

You can see how many pages from your old domain are indexed with the Query "site:olddomain.tld" at Google.
